California Labor Code §558 imposes civil penalties on employers who repeatedly violate overtime rules: $50 per pay period for an initial violation and $100 per pay period for each subsequent violation, on top of back wages owed. Under PAGA (the Private Attorneys General Act), an employee who has been denied overtime can pursue civil penalties not only for their own violations but also on behalf of other affected employees and the State of California. California law also requires employers to pay the prevailing employee’s attorney fees and costs in a successful wage claim.
